Terms of Service

The agreement between you and Legacy Wallet — what the service does and doesn't do, how the subscription works, and who is responsible for what.

About these terms

These terms are an agreement between you and the company that operates Legacy Wallet ("Legacy Wallet", "we", "us"). Its name, registered number and address will be published here before launch. The terms cover the Legacy Wallet app, the optional Legacy Account, the paid subscription, and this website.

By using any of them, you accept these terms. If you don't accept them, please don't use Legacy Wallet. Our Privacy Policy explains how we handle personal data.

The points that matter most

Only you hold your keys. Legacy Wallet is non-custodial. If you lose your recovery phrase, we cannot recover your wallet or your funds.

This records your wishes and helps your executor act. It does not replace a valid will or the probate process. Speak to a qualified adviser.

Blockchain transactions are final. Nobody, including us, can reverse them.

Nothing in Legacy Wallet is financial, investment, legal or tax advice.

Who can use Legacy Wallet

You must be 18 or over and able to enter into a binding contract. You must not be subject to sanctions, or live in a country where using Legacy Wallet would be against the law. Some features may not be offered in every country. You are responsible for following the laws that apply to you, including tax rules on crypto.

What Legacy Wallet is, and what it isn't

Legacy Wallet is software. It gives you:

  • a self-custody Solana wallet for sending, receiving and swapping tokens, collectibles, and connecting to apps;
  • a dead man's switch: an on-chain program that lets your chosen heir claim what you have deposited for them if you stop checking in; and
  • the Legacy Vault: items encrypted on your phone that are released to your heir only after a claim is finalised.

We are not a bank, exchange, broker, custodian, trustee or executor. We never hold your crypto or your money. We cannot freeze, move, recover or return your assets.

The on-chain program, not us, decides when a claim succeeds. It has no instruction that lets us step into a claim. When your timer runs out, your heir can start a claim, provided they have accepted the role. If you don't cancel it within the challenge window, it becomes final and the program lets your heir take what you deposited. We can't stop, hurry or reverse that.

We don't decide who is legally entitled to your estate. Assets that pass through Legacy Wallet do so outside any will or probate process. That can conflict with a will, with intestacy rules, or with other people's legal claims. Making sure your arrangements are lawful and fit your wider estate plan is your responsibility.

What passes to your heir

Only SOL that you deposit into the switch passes to your heir automatically. Other tokens, collectibles, and anything still in your wallet do not.

Deposits are one-way. You can't withdraw SOL you have deposited. It stays in the program until your heir claims it. If a claim is finalised and your heir doesn't collect, you can recover what is left after a grace period. Only deposit what you intend your heir to receive.

You can change your heir and your timer while no claim is finalised. You cannot currently switch the switch off. You keep it from firing by checking in.

Beta

The dead man's switch and the Legacy Vault are in beta:

  • During the beta they run on Solana's test network (devnet). SOL deposited there is test SOL with no value, and the switch does not cover assets on Solana's main network.
  • The on-chain program has not yet had an independent security audit, and while it is in beta we can still update its code.
  • Beta features may change, fail, or be withdrawn. Don't rely on them as your only plan.

Your responsibilities

  • Back up your recovery phrase and keep it somewhere safe and offline. Anyone who has it controls your wallet.
  • Check your heir's wallet address. Assets sent to the wrong address can't be recovered.
  • Check in before your timer runs out. Opening the app checks in for you. We send reminders, but we can't guarantee they reach you: your phone may be off, notifications may be disabled, or a provider may fail. Reminders are a courtesy, not a guarantee.
  • Keep your phone secure, with a passcode and biometric lock.
  • Tell the people who need to know — your heir or your executor — that Legacy Wallet is part of your plans.
  • Keep your vault lawful. We can't see what you store, but you are responsible for it.

The Legacy Account

The wallet works without an account. You need a Legacy Account only for the paid subscription. Keep your password secure; you are responsible for what happens through your account. The same account may sign you in to other Legacy services, which have their own terms. You can delete your account at any time in the app (Legacy Account → Delete account). Deleting it does not cancel a subscription; cancel that in your App Store or Google Play account.

The subscription

  • What it covers. Adding and changing Legacy Vault items, uploading files, and setting up the dead man's switch need an active subscription.
  • What stays free. The wallet, checking in, reading and deleting your vault items, and warnings never need a subscription. Heirs never pay: accepting the role, claiming, and opening released vault items are free.
  • Price. The price is shown in the app before you buy. It includes any tax your app store is required to charge.
  • Payment. You buy through the Apple App Store or Google Play. They take the payment, and their terms apply to it.
  • Renewal. The subscription renews automatically every year unless you cancel at least 24 hours before the end of the current period. Cancel or manage it in your App Store or Google Play account settings. When you cancel, you keep access until the end of the period you've paid for.
  • Refunds are handled by Apple or Google under their policies. Nothing in these terms affects your legal rights as a consumer, including any right to cancel within 14 days where that applies.
  • If your subscription ends, nothing you've set up is deleted. Your switch keeps running, and your heir can still claim and open released items. You won't be able to add or change vault items until you subscribe again.

Fees

Blockchain transactions carry network fees, which go to the Solana network, not to us. Swap providers, marketplaces and payment providers may charge their own fees. We don't currently charge a fee of our own on sends or swaps. If we introduce one, we'll show it to you before you confirm.

Other companies' services

Some features connect you to services we don't control: token swaps (Jupiter, Raydium), the Collectibles marketplace (Tensor, in beta), buying crypto (MoonPay), and apps you open or connect your wallet to. Their terms apply, and we are not responsible for them. Prices and token information come from third parties and may be wrong or out of date. Token safety ratings are information, not a recommendation.

Acceptable use

Don't use Legacy Wallet to break the law, including money-laundering, sanctions and fraud laws. Don't try to disrupt, overload, probe or break into our systems. Don't copy or reverse-engineer the app, except where the law allows it. Don't impersonate anyone.

Our rights in the app

We own Legacy Wallet's software, design and brand. We give you a personal, non-transferable, revocable licence to use the app for as long as these terms apply. Open-source components are covered by their own licences.

Apple and Google

If you got the app from Apple's App Store:

  • These terms are between you and us, not Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet an applicable warranty, you can tell Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • Apple is not responsible for dealing with any claim about the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection or similar law.
  • Apple is not responsible for investigating, defending, settling or discharging any claim that the app infringes someone's intellectual property.
  • You confirm that you are not in a country subject to a US Government embargo or designated as supporting terrorism, and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you got the app from Google Play, Google Play's terms also apply to your download and purchases.

Availability and changes

We work to keep Legacy Wallet running but can't promise it will always be available or error-free. It depends on the Solana network, our providers, and the app stores. Your recovery phrase works in other compatible Solana wallets, so you can reach your funds without us. Releasing Legacy Vault items does depend on our servers.

We may change or withdraw features. If we withdraw a paid feature, we'll give you reasonable notice. We may suspend your access if you seriously break these terms, if the law requires it, or to protect the service or other people. Suspension doesn't affect what is already on the blockchain.

Liability

Nothing in these terms limits or excludes liability that the law doesn't allow us to limit or exclude, including for death or personal injury caused by our negligence, or for fraud.

We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss caused by:

  • loss, theft or disclosure of your recovery phrase, keys or phone;
  • transactions that you or your heir approve, including ones sent to the wrong address;
  • a missed check-in, or a reminder that didn't reach you;
  • the Solana network, or services run by other companies;
  • changes in the value of any crypto asset; or
  • how the law treats your estate, including wills, probate and tax.

Where the law allows, our total liability to you is limited to the amount you paid us for the subscription in the 12 months before the claim.

Ending these terms

You can stop using Legacy Wallet at any time. Cancel your subscription in your app store account, delete your Legacy Account in the app, and delete the app. Ending these terms doesn't change anything already recorded on the blockchain. Your switch settings and deposits remain governed by the program.

Changes to these terms

We may update these terms. We'll post the new version here and change the date at the top. If a change materially affects you, we'll tell you in the app or by email before it takes effect. If you don't accept it, you can cancel before your next renewal.

Law and disputes

These terms are governed by the law of England and Wales. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts. If something goes wrong, please email us first. Most problems can be fixed quickly.
